Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and BPM Heating, Cooling & Plumbing (“BPM,” “we,” “our,” or “us”) regarding your use of our website bpmhvac.com and the services we provide.
By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the website or use our services.
Our Services
BPM Heating, Cooling & Plumbing provides residential and commercial HVAC services, including but not limited to:
- Heating system installation, repair, and maintenance
- Air conditioning installation, repair, and maintenance
- Plumbing services
- Indoor air quality solutions
- Ductwork services
- Emergency HVAC services
- Preventive maintenance programs
Service Area
Our primary service area includes Frederick, MD and surrounding communities. Service availability outside our standard service area is determined on a case-by-case basis and may incur additional travel fees.
Estimates and Quotes
Free Estimates
We provide free estimates for most services. Estimates are provided in good faith based on the information available at the time and are subject to change upon actual inspection of the work site and equipment.
Quote Validity
Written quotes are valid for 30 days from the date of issue unless otherwise specified. Pricing may change after this period due to material cost fluctuations or other factors.
Final Pricing
The final cost of services may differ from the initial estimate if additional work, parts, or unforeseen complications are discovered during the service. We will inform you of any significant changes to the estimated cost before proceeding with additional work that requires your authorization.
Payment Terms
Payment terms will be provided with your service agreement or invoice. We accept cash, checks, and major credit cards. For larger projects or equipment installations, payment arrangements will be discussed prior to beginning work.
Scheduling and Cancellations
Appointments
We make every effort to arrive during scheduled appointment windows. However, service times are approximate and may be affected by factors beyond our control, including weather, traffic, and emergency service calls.
Cancellations and Rescheduling
We request at least 24 hours’ notice if you need to cancel or reschedule an appointment. This allows us to serve other customers efficiently.
Access to Property
You must provide access to all areas where work is to be performed. If we are unable to access the necessary areas during a scheduled appointment, you may be charged a service call fee.
Warranties
Labor Warranty
We warrant our workmanship for a period of one (1) year from the date of service completion. If you experience any issues related to our workmanship during this period, we will correct the problem at no additional charge for labor.
Parts and Equipment Warranty
Parts and equipment are covered by the manufacturer’s warranty. Warranty periods vary by manufacturer and product. We will assist you in processing warranty claims for defective parts or equipment, but we are not responsible for manufacturer warranty limitations or exclusions.
Warranty Exclusions
Our warranties do not cover:
- Damage caused by misuse, abuse, or neglect
- Damage caused by improper maintenance
- Damage from acts of nature (lightning, flooding, etc.)
- Damage caused by alterations or repairs by unauthorized persons
- Normal wear and tear
- Equipment or systems not maintained according to manufacturer specifications
- Costs associated with gaining access to concealed parts or equipment
Warranty Claims
To make a warranty claim, contact us at info@bpmhvac.com or (240) 200-0887. Warranty service must be performed by BPM Heating, Cooling & Plumbing. Unauthorized repairs may void the warranty.
Maintenance Agreements
If you enroll in one of our maintenance agreement programs, additional terms and conditions specific to that program will apply and will be provided to you separately.
Liability and Disclaimers
Limitation of Liability
To the fullest extent permitted by law, BPM Heating, Cooling & Plumbing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort.
Our total liability to you for any damages shall not exceed the amount you paid us for the specific service giving rise to the claim.
Property Damage
We take reasonable precautions to protect your property during service. However, we are not responsible for:
- Pre-existing damage to property or equipment
- Damage to systems or equipment not serviced by us
- Damage to concealed or inaccessible items
- Damage caused by the necessary performance of our work (e.g., accessing equipment that requires cutting drywall)
We will make reasonable efforts to restore your property to its original condition after completing work that requires accessing walls, ceilings, or other structures.
Emergency Services
Emergency services are performed to restore essential function as quickly as possible. In emergency situations, a complete diagnosis may not be possible until the emergency is resolved. Additional work may be required after the emergency is addressed.
Customer Responsibilities
You agree to:
- Provide accurate information about your HVAC system and any problems
- Provide safe and adequate access to work areas
- Ensure pets are secured away from work areas
- Disclose any known hazards (asbestos, mold, etc.)
- Maintain equipment according to manufacturer recommendations
- Notify us immediately of any concerns during or after service
- Clear work areas of personal belongings and valuables
Permits and Codes
When required by law, we will obtain necessary permits for our work. All work performed will meet applicable local, state, and federal building codes and regulations. You are responsible for ensuring that any existing systems or modifications made by others meet code requirements.
Intellectual Property
The content on our website, including text, graphics, logos, images, and software, is the property of BPM Heating, Cooling & Plumbing and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without our express written permission.

You agree to indemnify, defend, and hold harmless BPM Heating, Cooling & Plumbing, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any rights of another party
- Any damage you cause to your property after we complete our work
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Entire Agreement
These Terms, along with our Privacy Policy and any written service agreements, constitute the entire agreement between you and BPM Heating, Cooling & Plumbing regarding our services.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our website and updating the “Last Updated” date. Your continued use of our services after any changes constitutes acceptance of the new Terms.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of BPM Heating, Cooling & Plumbing.
